Fundamental rights are such rights that are essential for intellectual, ethical and spiritual growth of citizens of India. Since these rights are fundamental or essential for existence and all-round growth of individuals, they are known as ‘Fundamental rights’.
The Fundamental Rights are defined as the fundamental human rights of citizens. These rights, defined in Part III of the Constitution, applied no matter race, place of birth, religion, caste, creed, sex, and equality of opportunity in matters of employment. They may be enforceable by the courts, subject to specific restrictions. The Directive Principles of State Policy are rules for its framing of legislation by the government. All these terms, set out in Part IV of the Constitution, are not enforceable by the courts, however the fundamentals on which they are based are basic principles for governance which the State is anticipated to employ in farming policies and passing laws.
The Fundamental Rights have been classified under the six categories-
- Right to Freedom
- Right to Equality
- Right against Exploitation
- Right to Freedom of Religion
- Cultural and Educational rights
- Right to constitutional remedies
